151.05 PROPERTY MAINTENANCE CODE ENFORCEMENT DEPARTMENT.
(A) Establishment.
(1) There is hereby established within and under the supervision, control and jurisdiction of the Village Police Department a Residential Property Maintenance Code Enforcement Department (hereinafter sometimes referred to as "Residential Code Enforcement"). The Chief of Police shall have charge of the management and operation of such department and its operations, and may delegate such other personnel from the Police Department to exercise managerial or supervisory authority over Code Enforcement field personnel (such Residential Code Enforcement field personnel hereinafter sometimes referred to as "Residential Code Enforcement Officers"), who shall be employees of the Village Police Department and subject to the rules and regulations thereof. Subject to the approval of the President and Village Board of Trustees, the Chief of Police may hire or appoint such other officers or employees as may be needed to enforce and administer the provisions of this code from time to time. While subject to the management and supervision of the Chief of Police or his or her designees, Residential Code Enforcement Officers shall not be sworn officers of the Department (but the foregoing shall not preclude any sworn officers of the Department from enforcing the provisions of this Code as may be necessary from time to time or as directed by the Chief of Police). Residential Code Enforcement, as herein constituted and established, shall primarily be designated with the responsibility for enforcing the provisions of this chapter as the same may apply to residentially zoned, developed or occupied properties within the village, but shall not be precluded from enforcing the provisions of this chapter as applied to non-residentially zoned, developed or occupied properties. Additionally, Residential Code Enforcement Officers shall have the primary responsibility for enforcing Chapter 93 of the Village Code of Ordinances, and for enforcing the provisions of § 132.43 of the Village Code of Ordinances prohibiting graffiti, as well as such other codes and ordinances of the village as may practically be assigned to Residential Code Enforcement from time to time by the Village Manager and/or the Chief of Police. Sworn officers of the Village Police Department shall enforce the provisions of this chapter as directed by the Chief of Police or his designee.
(2) There is hereby established within and under the supervision, control and jurisdiction of the Village Fire Department a Commercial Property Maintenance Code Enforcement Division (hereinafter sometimes referred to as "Commercial Code Enforcement"). The Fire Chief shall have charge of the management and operation of such division and its operations, and may delegate such other personnel from the Fire Department to exercise managerial or supervisory authority over Commercial Code Enforcement field personnel (such Commercial Code Enforcement field personnel hereinafter sometimes referred to as "Commercial Code Enforcement Officers"), who shall be employees of the Village Fire Department and subject to the rules and regulations thereof. Subject to the approval of the President and Village Board of Trustees, the Fire Chief may hire or appoint such other officers or employees as may be needed to enforce and administer the provisions of this code from time to time. While subject to the management and supervision of the Fire Chief or his or her designees, Commercial Code Enforcement Officers need not be sworn personnel of the Fire Department (but the foregoing shall not preclude any sworn personnel of the Fire Department from enforcing the provisions of this Code as may be necessary from time to time or as directed by the Fire Chief). Commercial Code Enforcement, as herein constituted and established, shall primarily be designated with the responsibility for enforcing the provisions of Chapter 151 and 159 of the Village Code as the same may apply to non-residentially zoned, developed or occupied properties within the village, but shall not be precluded from enforcing the provisions of this chapter as applied to residentially zoned, developed or occupied properties. Commercial Code Enforcement Officers shall also enforce such other ordinances of the Village as may practically be assigned to Commercial Code Enforcement from time to time by the Village Manager.
(B) Fees. Applicable fees for inspections, permits, approvals or other actions (excluding fines, costs, or costs of remediation imposed in any proceeding for violation of this chapter or this Code) shall be as set forth from time to time in Chapter 43 <https://codelibrary.amlegal.com/codes/romeoville/latest/romeoville_il/0-0-0-4578> of this Code.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
