An Ordinance Establishing Temporary Outdoor Dining Guidelines-COVID 19-Phase 3 Restore Illinois Plan

WHEREAS, the State of Illinois through its Department of Commerce and Economic Opportunity (“DCEO”) has released a series of guidelines for reopening Illinois businesses pursuant to Phase 3 of the Restore Illinois Plan; and
WHEREAS, the DCEO Phase 3 guidelines are attached as Exhibit A to this Ordinance; and,
WHEREAS, the DCEO Phase 3 guidelines further note that restaurants and bars subject to the DCEO Phase 3 guidelines may additionally be subject to applicable local regulation; and
WHEREAS, the Village has promulgated certain additional and complementary regulations to clarify and facilitate the application of the Phase 3 guidelines to restaurants and bars within the Village of Romeoville, a copy of which is attached as Exhibit B to this Ordinance; and
WHEREAS, the permission herein granted for outdoor operation shall terminate upon the expiration of applicable State of Illinois regulatory requirements restricting or prohibiting normal indoor operation at full capacity as the same existed prior to the COVID 19 gubernatorial disaster declaration.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: That the above recitals and referenced reports are hereby made a part of this Ordinance.
Section 2: That all restaurants, bars and other like establishments engaging in outdoor operations shall hereinafter be subject to the DCEO Phase 3 guidelines set forth in Exhibit A to this Ordinance, and to the Village of Romeoville guidelines set forth in Exhibit B to this Ordinance, for so long as the State of Illinois shall maintain in force and effect any regulatory requirements that restrict or prohibit any restaurant, bar or like establishment from operating at full capacity as the same existed prior to the COVID 19 gubernatorial disaster declaration. All alcohol service shall additionally comply with Chapter 112 of the Village Code of Ordinances. Upon the expiration or termination of any State of Illinois regulatory requirements that restrict or prohibit any restaurant, bar or like establishment from operating at full capacity as the same existed prior to the COVID 19 gubernatorial disaster declaration, the permission herein granted shall likewise expire or terminate, and all outdoor dining, food service or beverage service shall be subject to the otherwise applicable ordinances of the Village of Romeoville without regard to this Ordinance.
Section 3: That this ordinance shall be in full force and effect from and after its passage as provided by law, and pursuant to 65 ILCS 5/1-2-4 of the Illinois Compiled Statutes, this written and foregoing Ordinance is published by authority of the corporate authorities of said Village of Romeoville in the within pamphlet form on this date, and a photocopy of this within Ordinance is deemed in such pamphlet form.
