A Resolution Authorizing the Waiving of Bids for a 14-Passenger Bus for the Parks and Recreation Department with Best Bus Sales

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of tis Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville had acquired quotes in 2017 for a 14-passenger bus; and
WHEREAS, based upon review of the applicable proposals and vendor recommendations from other organizations, the Village of Romeoville had determined to accept the proposal from Best Bus Sales in Des Plaines, Illinois for a 14-passenger bus for the Village Parks and Recreation Department; and
WHEREAS, the Village of Romeoville has been pleased with the service and quality of our previous vendor and bus and would like to purchase another 14-passenger bus from Best Bus Sales based upon its quote for a 2024 Universal Ford E-450 FF Passenger Bus for a total cost of $123,816.00, including a 3-year/36,000-mile motor warranty, a 5-year/100,000-mile body warranty, and a 5-year/100,000-mile powertrain warranty, upon the terms and conditions set forth in the quote submitted to the Village by Best Bus Sales attached hereto and incorporated herein as Exhibit A.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirement: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to the provision of a 14-passenger bus for the Village Parks and Recreation Department and authorize the purchase of a 14-passgenger bus upon the terms, conditions, provisions of the proposal from Best Bus Sales set forth in Exhibit A to this Resolution (a copy of which is attached hereto and incorporated herein by reference).
Section 3: That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
Section 4: Repealer: All other Resolutions or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
Section 5: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, or void, the same shall not affect the validity of enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions or sections thereof.
Section 6: Effective Date: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
