An Ordinance Amending Chapter 74 (Parking) of the Village Code of Ordinances

WHEREAS, the Village of Romeoville has heretofore adopted certain ordinances now codified as and for Chapter 74 of the Village Code of Ordinances pertaining to the regulation of parking within the Village on Village streets and property; and
WHEREAS, after Village staff review, it has been determined that amendments to Chapter 74 are required to facilitate the establishment of parking permit enforcement measures for the Romeoville Metra Station Parking Lot.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT OF CHAPTER 74 OF VILLAGE CODE OF ORDINANCES. Sections 74.12 and 74.13 of the Village Code of Ordinances shall hereby be amended to read as hereinafter set forth:
§ 74.12 PARKING AT THE ROMEOVILLE METRA STATION.
(A) Except as may be otherwise authorized by the Village Manager or their designee, no person shall be allowed to park a vehicle at the Romeoville Metra Station without first purchasing a numbered daily fee space corresponding to the exact numbered location at which the vehicle is parked, or without displaying a daily, semiannual or annual parking pass. Daily fee spaces shall be available on a first come, first served basis. Due to the size and existing configuration of the Romeoville Metra Station Parking Lot, no daily fee spaces exist or are available for use or permitting by any bus as defined in the Illinois Vehicle Code, and no bus as so defined shall park, stop, stand or discharge passengers at the Romeoville Metra Station, provided, however, that the foregoing prohibition shall not apply to buses owned or operated by Pace, Metra, RTA or other governmental transportation authority.
(B) No person shall be allowed to park at the Romeoville Metra Station other than in the appropriate designated parking areas. Designated parking areas shall be separately established for daily passes and for semiannual and annual passes. A parking citation issued pursuant to this subsection shall carry a fine in the amount of $30.00 pursuant to Section 74.09(B) of the Village Code of Ordinances.
(C) The Village Board shall establish daily, semiannual and annual fees to be charged for the privilege of parking at the Romeoville Metra Station in an amount as set forth in the fee schedule contained within Chapter 43 of the Village Code.
§ 74.13 ROMEOVILLE METRA STATION PARKING PERMITS/DAILY FEE SPACES.
Except as may be otherwise authorized by the Village Manager or their designee, no person shall park any vehicle within the Romeoville Metra Station Parking Lot without a semiannual or annual parking permit obtained in accordance with this Section and any permit parking rules and regulations promulgated by the Village from time to time, or without having purchased a numbered daily fee space corresponding to the exact numbered location at which the vehicle is parked.
(A) Rules and Regulations. The Village shall promulgate permit parking rules and regulations as necessary to implement the provisions of this Section and § 74.12 concerning the issuance and use of commuter parking permits. A copy of such rules and regulations shall be available at Village Hall and amendments to the same shall be mailed to each permit holder when substantive changes are made to the rules and regulations. Signage advising of the existence of such regulations and of the means of reviewing the same shall be posted within the Metra Station Parking Lot.
(B) Towing. The Romeoville Metra Station parking lot is hereby designated as a “tow away zone” and shall be appropriately posted as such. Any vehicle parked in violation of this Section or Section 74.12 may be towed by order of the Romeoville Police Department as an unlawful vehicle pursuant to Section 81.22(B) of this Code, and any bus parked in violation of this Section or Section 74.12 of this Chapter shall further be subject to impoundment as set forth in Section 81.251 of this Code, and this sentence shall hereby be deemed to be incorporated by this reference into Appendix A to Chapter 81 of the Village Code of Ordinances. Any such towing of a vehicle shall not preclude the issuance of a citation to the owner of such vehicle for violating Section 74.12 or Section 74.13.
(C) Parking Permit Issuance and Permit Fee Payment
(1) Daily Parking Permits. Daily Parking Permits may be purchased at a pay station located within the Romeoville Metra Station Parking Lot, and may be paid for in cash using exact change only, or with a credit card or mobile phone. Payments made by credit card or mobile phone will be subject to an electronic transaction fee in addition to the fee for the daily parking permit. All daily parking permits must be purchased and paid for prior to 10:00 a.m. on the desired permit date.
(2) Semiannual and Annual Parking Permits. Semiannual and annual parking permits may only be purchased through the Village’s third party parking services provider, and may be purchased through the provider’s website, mobile app, or by phone. All purchases of semiannual or annual parking permits will be subject to an electronic transaction fee in addition to the fees for the desired parking permit. Further information concerning the then-current information regarding the purchase of semiannual and annual parking permits through the Village’s third party parking services provider may be obtained from the Village website at www.romeoville.org <http://www.romeoville.org> or by contacting the Village at (815) 886-7200.

(D) Fees. All parking fees as established by the fee schedule set forth in Chapter 43 of this Code shall be paid before any commuter parking permit is issued. All fees paid pursuant shall be nonrefundable.
(E) Electronic Transaction Fees. For the convenience of customers and users of the Romeoville Metra Station Parking Lot, the Village has contracted with a provider of electronic parking payment services to permit payment of parking fees on an online basis. By using these electronic payment services, customers and users consent to the imposition of service fees in connection therewith, in such amounts as may be compliant with and required by the Village’s then-current contract with its electronic parking payment services provider.
SECTION 4: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 5: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency, and upon such repeal the relevant substantive provisions thereof shall be deemed to be replaced with the relevant substantive provisions hereof.
SECTION 6: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its approval and publication in pamphlet form as provided by law, subject to final Village Manager and Village Attorney review and approval.
