An Ordinance Amending Chapter 150 of the Village Code of Ordinances (Adoption of Illinois Elevator Safety Act and Administrative Rules)

                     WHEREAS, a periodic review of the ordinances of the Village of Romeoville has indicated that certain revisions are presently necessary thereto to incorporate compliance with applicable statutory and regulatory requirements, specifically the Elevator Safety and Regulation Act, 225 ILCS 312/1 et. seq. and the Illinois Elevator Safety Rules, 41 Ill. Adm. Code 1000 et. seq.

 

                     WHEREAS, it is in the best interests of the Village to enact the aforementioned amendments to Chapter 150 of the Village Code of Ordinances as more fully hereinafter set forth and in the exercise of the Village’s home rule authority.

 

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

SECTION 2:  AMENDMENT TO CHAPTER 115.  All those heretofore enacted ordinances of the Village codified as and for Chapter 115 of the Village Code of Ordinances are hereby amended to read as set forth below, and codified as and for a new Section 115.14A of the Village Code of Ordinances:

 

§ 150.14A  ADOPTION OF THE ILLINOIS ELEVATOR SAFETY AND REGULATION ACT AND ADMINISTRATIVE RULES.

 

   There is adopted by the village for the purpose of establishing rules and regulations for public safety as it pertains to the design, construction, operation, inspection, testing, maintenance, alteration, and repair of elevators, dumbwaiters, escalators, moving sidewalks, platform lifts, stairway chairlifts, and automated people conveyances to all buildings, premises, site and appurtenances, an act known as the Elevator Safety and Regulation Act, 225 ILCS 312/1 et. seq., as amended, and the Illinois Elevator Safety Rules, 41 Ill. Adm. Code 1000 et. seq. as amended, of which not less than one copy of each has been filed in the Office of the Village Clerk. The act and the rules are adopted and incorporated as if fully set forth herein. From and after the date on which this section shall take effect, the provisions thereof shall be controlling as to all buildings and other structures within the corporate limits of the village.  When there are conflicts between the Act and the Rules hereby adopted and any other village codes, standard or ordinance the stricter of the two shall govern.

 

 

 

SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
