A Resolution to Approve a Proposal from Artistic Holiday Designs for the Purchasing, Leasing and Installation of additional Holiday Lights and Decorations for 2024

WHEREAS, the Village of Romeoville has planned a Winter Event and would like to purchase and lease additional holiday lights and event decorations; and
WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of two-thirds of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and
WHEREAS, the Village of Romeoville has heretofore received a quote from Artistic Holiday Designs for purchasing, leasing and installation of additional holiday lights and decorations for 2024 in the amount not to exceed $68,179.28 (see Exhibit A);
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:
Section 1: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: By a two-thirds vote of the corporate authorities of the Village, applicable competitive bidding requirements under the Illinois Municipal Code and the Village Code of Ordinances are hereby waived, and the Village President and Village Clerk are hereby authorized and directed to proceed with the purchasing, leasing and installation of additional holiday lights and decorations to display along Grand Avenue and in front of Village Hall, pursuant to the terms of the proposal attached hereto and incorporated herein as Exhibit A to this Resolution, subject to final Village Manager and Village Attorney review.
Section 3: That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.
Section 4: All prior Resolutions and Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.
Section 5: This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
EXHIBIT A
VILLAGE OF ROMEOVILLE/ARTISTIC HOLIDAY DESIGNS TERMS, CONDITIONS AND PROVISIONS FOR THE PURCHASING, LEASING AND INSTALLATION OF ADDITIONAL HOLIDAY LIGHTS AND DECORATIONS FOR 2024.
Upon the Village’s written receipt from Artistic Holiday Designs of written acceptance of the terms, conditions and provisions of this resolution, said terms, conditions and provisions, including but not limited to the terms, conditions and provisions set forth below in this Exhibit A, shall serve as and for a contract between the Village of Romeoville and Artistic Holiday Designs for the provision for the purchasing, leasing and installation of additional holiday lights and decorations to display along Grand Avenue, in front of Village Hall, at the Recreation Center, Athletic Center, and Aquatic Center for 2024.
