An Ordinance Amending the Designating Ordinance of the Village of Romeoville in Connection with the Des Plaines River Valley Enterprise Zone

                     WHEREAS, in 2014, the Village of Romeoville entered into an intergovernmental agreement with the County of Will, the City of Joliet, the Village of Lockport and the Village of Rockdale to establish a joint enterprise zone to be known as the Des Plaines River Valley Enterprise Zone, which agreement was later amended to include the Village of Romeoville; and

 

WHEREAS, in accordance with said agreement and the Illinois Enterprise Zone Act (20 ILCS 655/5.1 et seq.) the Mayor and Village Board adopted Ordinance No. 14-1166 designating certain territory within the Village of Romeoville as an enterprise zone , and such designations which as deemed necessary are done from time to time, and approved and certified by the State of Illinois; and

 

WHEREAS, the State of Illinois subsequently approved and certified the joint enterprise zone and subsequent expansion to include the territory as depicted in Exhibit A within the Village of Romeoville; and

 

WHEREAS, the parties last amended the zone boundaries in the Intergovernmental Agreement and the Designative Ordinance of each party in 2024; and

 

 

WHEREAS, on July 9, 2025, a public notice and public hearing regarding the foregoing proposal will be held as required by Section 5.4 of the Illinois Enterprise Zone Act, where the Board of Directors of the Des Plaines River Valley Enterprise Zone will recommend that this Amendment be adopted by the corporate authorities of the parties.

 

                     WHEREAS, the President and Board of Trustees of the Village of Romeoville hereby find and determine that the amendment of the zone is in the best interest of the Village of Romeoville; and

 

                     WHEREAS, this Ordinance is adopted in accordance with the Illinois Enterprise Zone Act and pursuant to the powers of the Village of Romeoville.

 

                     NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, ILLINOIS AS FOLLOWS:

 

 

SECTION 1RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

                     SECTION 2:  Section 4 of Ordinance No. 14-1166 of the Village of Romeoville, as amended, being the certified designating ordinance adopted by the Village of Romeoville in connection with the establishment of the Des Plaines River Valley Enterprise Zone, is hereby amended to read as follows:

 

                     The area of the designated Enterprise Zone shall have the legal description and be as depicted in the map that are set fort in Exhibit A, a copy of which is attached hereto and incorporated hereto by reference.

 

                     SECTION 3:  This Ordinance is strictly intended to approve the area designated as the Minnick Services Property to the enterprise zone.  In the event the State of Illinois does not approve and certify the addition of the Minnick Services Property, the addition of the enterprise zone shall remain as originally certified by the State of Illinois.

 

                     SECTION 4:  The Village Manager is hereby authorized to submit a certified copy of this Ordinance to the State of Illinois, the Enterprise Zone Board of the Des Plaines River Valley Enterprise Zone Board and to the administrators, representatives and corporate authorities of the County of Will, the City of Lockport, the Village of Rockdale and the City of Joliet and other interested persons. 

 

SECTION 5:                     SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 6CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION 7:  REPEALER.  All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed.

 

                     SECTION 8EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law
