An Ordinance Amending the Designating Ordinance of the Village of Romeoville in Connection with the Des Plaines River Valley Enterprise Zone

WHEREAS, in 2014 the Village of Romeoville entered into an intergovernmental agreement with the County of Will, the City of Joliet, the Village of Lockport and the Village of Rockdale to establish a joint enterprise zone to be known as the Des Plaines River Valley Enterprise Zone, which agreement was later to be amended to include the Village of Romeoville; and,
WHEREAS, in accordance with said agreement and the Illinois Enterprise Zone Act (20 ILCS 655/5.1 et seq.), the Mayor and Village Board adopted Ordinance No. 14-1166 designating certain territory within the Village of Romeoville as an enterprise zone, subject to the approval and certification of the State of Illinois; and,
WHEREAS, the State of Illinois subsequently approved and certified the joint enterprise zone and its subsequent expansion to include territory within the Village of Romeoville; and,
WHEREAS, the State of Illinois has provided for the extension of the termination date of the enterprise zone set forth in the designating zone ordinances adopted and amended by each of the signatory jurisdictions; and,
WHEREAS, the Mayor and Village Council hereby find and determine that the amendment of the area designated as the enterprise zone is in the best interest of the Village of Romeoville; and,
WHEREAS, this Ordinance is adopted in accordance with the Illinois Enterprise Zone Act and pursuant to the home rule powers of the Village of Romeoville.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND VILLAGE COUNCIL OF THE VILLAGE OF ROMEOVILLE, ILLINOIS, AS FOLLOWS:
SECTION 1: Section 4 of Ordinance No. 14-1166 of the Village of Romeoville, as amended, being the certified designating ordinance adopted by the Village of Romeoville in connection with the establishment of the Des Plaines River Valley Enterprise Zone, is hereby amended to read as follows:
The area of the designated Enterprise Zone shall have the legal description and be as depicted in the map that are set forth in Exhibit A, a copy of which is attached hereto and incorporated herein by reference.
SECTION 2: This Ordinance is strictly intended to alter the area designated as the enterprise zone. In the event the State of Illinois does not approve and certify the same, the designation of the enterprise zone area shall remain as originally certified by the State of Illinois.
SECTION 3: The Village Manager is hereby authorized to submit a certified copy of this Ordinance to the State of Illinois, the Enterprise Zone Board of the Des Plaines River Valley Enterprise Zone Board and to the administrators, representatives and corporate authorities of the County of Will, the Village of Lockport, the Village of Rockdale and the City of Joliet and other interested persons.
SECTION 4: This Ordinance shall be considered severable. The invalidity of any portion hereof shall not be deemed to invalidate the remainder.
SECTION 5: This Ordinance shall be in effect upon its passage.
