An Ordinance Amending Chapter 91 of the Village Code of Ordinances (Fireworks Violation Fines)

                     WHEREAS, periodic review of the provisions of Chapter 91 (Fire Prevention) of the Village Code of Ordinances has indicated the need for certain amendments to Chapter 91; and

 

                     WHEREAS, it is in the best interests of the Village to adopt certain specific fines for violations of Section 91.30 pertaining to unlawful fireworks displays and/or the use of sky lanterns

 

                     NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

                     SECTION 1:  RECITALS.  The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.

 

                     SECTION 2:  ADOPTION OF CHAPTER 91 AMENDMENTS.  That all heretofore adopted Village Ordinances codified as and for Chapter 91.99 shall be and hereby are amended as set forth below, and the same shall thereafter be codified as and for Section 91.99(E) of the Village Code of Ordinances:

91.99(E)                     Unlawful Displays of Fireworks or Use of Sky Lanterns.  For any violations of Section 91.30 of this Code, the fines and penalties shall be as follows:

                     (1)                     For a first offense in any twelve month period, $50.00

                     (2)                     For a second offense in any twelve month period, $250.00

(3)                     For a third or subsequent offense in any twelve month period, $500.00

SECTION 3:  SEVERABILITY.  That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

                     SECTION 4:  CONFLICTS.  All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. 

 

                     SECTION 5: EFFECTIVE DATE.  This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
