A Resolution to Waive the Bid Process and Accept the Proposal from Water Well Solutions for Emergency Repairs on Well #4

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, the pumping equipment on Well #4 experienced a catastrophic failure and requires complete replacement; and,
Whereas, a proposal of $395,130 has been received from Water Well Solutions that includes new submersible pumping equipment and materials including installation and testing in addition to the initial emergency repairs and assessment cause of failure cost of $38,810 for a total of $433,940; and,
Whereas, the funds from two expense accounts will be utilized for the expense.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the new pumping equipment and materials including installation and testing in addition to the initial emergency repairs and accept the proposal from Water Well Solutions for a total cost of $433,940.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
