A Resolution Authorizing an Amendment to Len Cox & Sons Excavating Contract for Additional Repairs for the Watermain Rehabilitation from Macon Ave to Post Office

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and
Whereas, previously approved Resolution 22-3442 authorized entering into contract with Len Cox & Sons Excavating for the watermain rehabilitation from Macon Ave to Post Office; and
Whereas, the Village shall compensate Len Cox & Sons Excavating for an estimated fee of $141,660.00 and provides for the potential additional expenditures for services as authorized by the Village Manager
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Adjustment to Contract: The Village of Romeoville hereby approves in an amount not to exceed $141,660.00, provided, further, however, that notwithstanding the preceding clause, expenditures for services within the scope of 135th St watermain boring may be made in amounts in excess of $141,660.00 but only upon the express approval of the Village Manager.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
