An Ordinance Amending Chapter 37 of the Village Code of Ordinances (Employee Benefits and Policies)

WHEREAS, it is the responsibility of the Corporate Authorities to periodically review the compensation and benefits paid to elected officials within the Village of Romeoville to ensure that the same are commensurate with the duties and responsibilities undertaken by such officials; and
WHEREAS, the most recent such review indicates that certain revisions to Chapter 37 of the Village Code of Ordinances are necessary in order to appropriately determine the compensation and benefits paid to elected officials within the Village of Romeoville; and
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT TO CHAPTER 37.142 OF THE VILLAGE CODE OF ORDINANCES. Those provisions of all heretofore adopted Village Ordinances codified as and for Chapter 37.142 of the Village Code of Ordinances are hereby amended to read as set forth below:
§ 37.142 ELECTED OFFICIALS’ HEALTH INSURANCE BENEFITS.
(A) All elected officials holding office as of the April 2019 elections and who were thereafter sworn into a subsequent term of office by virtue of such elections shall, from and after the date upon which they leave elected office of the village, be entitled to receive and maintain village health insurance coverage from and after leaving office for a period of time equal to such official’s cumulative length of service as an elected official of the village. Such coverage shall be available to such officials on the same terms and conditions on which such coverage was provided during such officials’ terms of office; without otherwise limiting the generality of the foregoing, such coverage shall likewise be available during such time period to the surviving spouse or family members of such officials in the event of the death of such officials during the period of time subsequent to such officials’ terms of office in which such officials would be entitled to village health insurance coverage pursuant to this division (A). The provisions of this division (A) are declarative of the existing ordinances of the village.
(B) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2023 elections, and notwithstanding any other provision of this code or of any village policy, all such elected officials shall thereafter only be eligible to receive village employee health insurance benefits, on the same terms and conditions as otherwise available to any village employees, and at the same cost and expense payable by village employees. Elected officials eligible for village employee health insurance benefits under this division (B) may, in lieu of receiving such benefits, provide the village with a written waiver of such benefits and receive an annual stipend in an amount equal to the stipend from time to time, payable to village employees who waive village employee health benefits. Elected officials eligible for village employee health insurance benefits under this division (B) who are otherwise eligible for employee health insurance benefits through other employment or as a result of spousal employment may receive village employee health insurance benefits under this division (B); provided, however, that such elected officials shall, in addition to any other costs for which they are responsible hereunder, pay an annual contribution to the village in the amount of $1,500 toward the cost of such coverage. At such time as an elected official eligible for village employee health insurance benefits under this division (B) shall leave office whether due to expiration of term, resignation or otherwise, the eligibility of such elected officials to receive village employee health insurance benefits shall likewise terminate; provided, however, that such elected officials shall have all rights otherwise legally available to receive village employee health insurance benefits through the provisions of the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA). The provisions of this division (B) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2023 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2023 elections shall be subject in any manner or to any extent to the provisions of this division (B).
(C) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2025 elections, and notwithstanding any other provision of this code or of any village policy, all such elected officials shall thereafter only be eligible to receive the lowest cost option village employee health insurance individual coverage benefits (to the exclusion of spousal or family coverage benefits), on the same terms and conditions as otherwise available to any village employees, and at the same cost and expense payable by village employees. Elected officials may, at their cost and expense, obtain village employee health insurance other than the lowest cost option, but shall pay the difference between the price of the lowest cost option and the option selected by the elected official. Elected officials eligible for village employee health insurance benefits under this division (C) who are otherwise eligible for employee health insurance benefits through other employment or as a result of spousal employment may receive village employee health insurance benefits under this division (C); provided, however, that such elected officials shall, in addition to any other costs for which they are responsible hereunder, pay an annual contribution to the village in the amount of $1,500 toward the cost of such coverage. At such time as an elected official eligible for village employee health insurance benefits under this division (C) shall leave office, whether due to expiration of term, resignation or otherwise, the eligibility of such elected officials to receive village employee health insurance benefits shall likewise terminate; provided, however, that such elected officials shall have all rights otherwise legally available to receive village employee health insurance benefits through the provisions of the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA). The provisions of this division (C) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2025 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2025 elections shall be subject in any manner or to any extent to the provisions of this division (C).
(D) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2027 election and after each subsequent election thereafter, and notwithstanding any other provision of this code or of any village policy, all such elected officials shall thereafter be ineligible to receive any village employee health insurance benefits under any circumstances, and shall likewise be ineligible to participate in the Illinois Municipal Retirement Fund (IMRF) under any circumstances, provided, however, that the provisions of this division (D) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2027 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2027 elections shall be subject in any manner or to any extent to the provisions of this division (C).
SECTION 3: AMENDMENT TO CHAPTER 37.143 OF THE VILLAGE CODE OF ORDINANCES. Those provisions of all heretofore adopted Village Ordinances codified as and for Chapter 37.143 of the Village Code of Ordinances are hereby amended to read as set forth below:
§ 37.143 ELECTED OFFICIALS’ COMPENSATION ADJUSTMENTS; LICENSE AND INCENTIVE AGREEMENT ELIGIBILITY.
(A) From and after commencement of the terms of office of all newly elected village officials sworn into office after the April 2025 elections, all village elected officials shall be prohibited from holding licenses or license endorsements issued pursuant to Chapter 112 or pursuant to Chapter 118, or from holding special use permits issued to permit the operation of a cannabis facility, as the same is defined under Chapter 157.
(B) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2025 elections, all newly elected village officials shall be prohibited from entering into an economic incentive agreement or redevelopment agreement with the village. As used herein, an ECONOMIC INCENTIVE AGREEMENT shall mean and include any agreement pursuant to which the village rebates, refunds or shares sales tax revenues or any other non-real estate tax revenues with the owner, developer or occupant of real estate within the village, and a REDEVELOPMENT AGREEMENT shall mean and include any agreement pursuant to which the village provides incentive payments generated from incremental real estate taxes to an owner, developer or occupant of real estate. However, benefits, rebates or refunds made to village residents under programs of general applicability to similarly situated residents shall not be included within the meanings of the terms ECONOMIC INCENTIVE AGREEMENT or REDEVELOPMENT AGREEMENT as used in this section.
(C) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2025 elections, all newly elected village trustees and clerks without prior service in such village elected offices shall be compensated under the provisions of village Ord. 06-0445, as if such trustees and clerks were being initially sworn into office in 2009, and all newly elected village presidents without prior service in such elected office shall be compensated under the provisions of village Ord. 06-0446 (without regard to the provisions of § 2(b) thereof which have previously been repealed), as if such village presidents were being initially sworn into office in 2009. The provisions of this division (C) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2025 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2025 elections shall be subject in any manner or to any extent to the provisions of this division (C).
(C-1) From and after commencement of the terms of office of the next nonincumbent Village President sworn into office after the April 2027 election, such nonincumbent Village President shall receive an annual fixed compensation in the amount of $28,000 for serving as Village President and Local Liquor Control Commissioner notwithstanding any other ordinance of the Village (including but not limited to the provisions of Village Ordinance No. 06-0446), provided, however, that the provisions of this division (C-1) shall not apply to any Village President holding office immediately prior to the swearing in occurring after the April 2027 election, and no Village President presently in office shall under any circumstances be subject to any extent to the provisions of this division (C-1).
(C-2) From and after commencement of the terms of office of the next nonincumbent Village Trustees and Village Clerk sworn into office after the April 2027 election, such nonincumbent Village Trustees and Village Clerk shall receive an annual fixed compensation in the amount of $12,000 for serving as Village Trustees and Village Clerk notwithstanding any other ordinance of the Village (including but not limited to the provisions of Village Ordinance No. 06-0445), provided, however, that the provisions of this division (C-2) shall not apply to any Village Trustee or Village Clerk holding office immediately prior to the swearing in occurring after the April 2027 election, and no Village Trustee or Village Clerk presently in office shall under any circumstances be subject to any extent to the provisions of this division (C-2).
(D) Notwithstanding any contrary provisions of village Ord. 06-0446 or of any other applicable village ordinance or policy, from and after commencement of the terms of office of all newly elected village officials sworn into office after the April 2025 elections, all village elected officials who are employed by, compensated by or receiving a pension from any other unit or instrumentality of the state (including, but not limited to, the state itself) shall have the annual compensation otherwise due and payable to them per the applicable ordinances of the village reduced by an amount equal to the annual compensation or pension benefits received by such village elected officials. In the event that the annual compensation or pension benefits received by a village elected official from any other unit or instrumentality of the state exceeds the annual compensation due to such elected official from the village, such an elected official shall, in that instance, serve without receiving the compensation otherwise provided for by applicable village ordinances. The provisions of this division (D) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2025 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2025 elections shall be subject in any manner or to any extent to the provisions of this division (D).
(E) From and after commencement of the terms of office of all village elected officials sworn into office after the April 2025 elections, all newly elected village officials shall be prohibited from holding other publicly elected office during their village terms of office. In the event that the preceding sentence shall be ruled or determined to be unenforceable by a court of competent jurisdiction, then all such elected officials shall have their village compensation adjusted as set forth above in division (D) above. The provisions of this division (E) shall not apply whatsoever to any village elected official holding office immediately prior to the commencement of the terms of office of all village elected officials sworn into office as a result of the April 2025 elections, and no presently serving village elected official who shall be reelected into the office presently occupied as a result of the April 2025 elections shall be subject in any manner or to any extent to the provisions of this division (E).
(F) From and after the commencement of the term of Office of the Village President sworn into office after the April 2025 elections, the compensation due and owing to the Village President for performing the duties of such office together with the compensation due and owing to the Village President for performing the duties of Local Liquor Control Commissioner may be paid as a single salary compensating for the performance of the duties of both offices.
SECTION 5: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 6: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency. .
SECTION 7: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law, subject to final Village Manager and Village Attorney review and approval.
