A Resolution Pursuant to Section 4.D.Vii of the Intergovernmental Agreement Between the Village of Romeoville and the Grand Prairie Water Commission Establishing a Joint Improvement Program

WHEREAS, the Village of Romeoville (the “Village”) is a member of the Grand Prairie Water Commission (the “Commission”), together with the City of Joliet, the Village of Channahon, the City of Crest Hill, the Village of Minooka, and the Village of Shorewood; and
WHEREAS, pursuant to Article VII, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act, 5 ILCS 220, the Village and the Commission have the power to contract or otherwise associate among themselves “to obtain or share services and to exercise, combine or transfer any power or function, in any manner not prohibited by law or by ordinance” as well as to use their revenues, credit and other resources for such activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., also authorizes the joint use and enjoyment of the powers, privileges, functions and authority of the Village and the Commission; and
WHEREAS, the Commission and Village have authorized and will execute a certain intergovernmental agreement (the “IGA”) pertaining to the conduct of certain joint/parallel projects by the parties, as approved by Village Resolution No. 26-4216; and
WHEREAS, the IGA identifies certain projects to be constructed by the Commission (the “Commission Projects”) and certain projects to be constructed by the Village (the “ Projects”); and
WHEREAS, pursuant to Section 4.D.iv of the IGA, the Village is required to adopt a resolution either (a) authorizing proceeding with a Village Project as a joint/parallel project under the IGA and authorizing the deposit of funds into escrow to defray its obligations to pay the cost of the Village Project, or (b) withdrawing a Village Project as a joint/parallel project under the IGA; and
WHEREAS, the Village has determined that proceeding with the Village Project identified in the IGA as Member Project 06-07 (Airport Road 20 inch water main) and depositing funds into escrow to cover the cost thereof is presently in the best interests of the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE President and Board of Trustees of the Village of Romeoville, COUNTY OF WILL, STATE OF ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated in and made a part of this resolution as findings of the Village Board of the Village by this reference.
SECTION TWO: APPROVAL OF MEMBER PROJECT 06-07; AUTHORIZATION OF DEPOSIT OF FUNDS INTO ESCROW . The Village hereby authorizes and approves proceeding with the work identified as Member Project 06-07 in the IGA as a joint project under the IGA, and further authorizes and approves a deposit into escrow of funds in the amount required by the provisions of Section 5 of the IGA.
SECTION THREE: APPPROVAL AND EXECUTION OF IGA. The approvals herein contained are conditioned upon the approval and execution of the IGA by the Commission and the Village.
SECTION FOUR: DELIVERY OF RESOLUTION. The Village Clerk is hereby authorized and directed to return a signed copy of the Agreement and a certified copy of this resolution to the Commission within fourteen (14) days after the date of adoption of this resolution.
SECTION FIVE: EFFECTIVE DATE. This resolution shall be in full force and effect upon its passage and approval in the manner required by law.
