A Resolution Authorizing an Increase to Martin Cement’s Contract to Construct the Foundation for the New Storage Building at the Public Works Site

Whereas, the Village of Romeoville (“The Village”) is a municipality in accordance with the Constitution of the State of Illinois of 1970; and,
Whereas, Resolution 20-2965 authorized entering into contracts with specific contractors to perform various facility improvements as part of the Public Works Facilities Construction Project Phase 1B up to certain Not to Exceed amounts; and,
Whereas, Martin Cement is the contractor authorized by Resolution 20-2965 to construct the building foundation for an amount not to exceed $120,000; and,
Whereas, the soil conditions encountered at the proposed location of the building are unsuitable for supporting a standard foundation per the evaluation of a licensed structural engineer, and a more robust foundation including construction of concrete caissons is necessary to properly support the proposed building; and,
Whereas, an increase of $225,404 to the amount originally authorized for Martin Cement to construct the building foundation and concrete slab is necessary to construct the more robust foundation, and this additional amount is available within the overall budgeted amount for the Public Works Facilities Project Phase 1B.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Adjustment of Contract: The Village of Romeoville approves an increase in the amount of $225,404 for the contract with Martin Cement to construct the storage building foundation included in the Public Works Facilities Construction Project Phase 1B.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
