A Resolution Updating the Awarded Amount with Abbey Construction due to Modifications during Construction for the Village Hall Parking Lot Expansion Project

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, a previous board approved resolution entered into a contract with Abbey Construction for the Village Hall Parking Lot Expansion along with a resolution for the increase to the contract for the stabilization change order; and,
Whereas, unforeseen field changes were required to complete the project resulting in additional cost of $62,312.74 to the project total; and,
Whereas, staff recommends approving an additional $62,312.74 toward the awarded contract amount with Abbey Construction, bringing the final awarded contract total to $1,137,098.24.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to updating the contract amount with Abbey Construction for the Village Hall Parking Lot Expansion Project, increasing the approved amount by $62,312.74, bringing the final contract amount to $1,137,098.24.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
