A Resolution Extending the Contract with Homer Tree Care Inc for Tree Removal Services for an Additional Year Term

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, the expenditures for the tree removal services will be expensed in fiscal year 26/27, account number 01.08.15.402; and,
Whereas, the contract terms allowed for a renewal for an additional year under the same terms of the contract if mutually agreed by both parties, Homer Tree Care Inc. has agreed to provide services under the terms of the contract for an additional year.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.

Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable for the extension of the contract for an additional year for tree removal services from Homer Tree Care Inc. based upon the following unit prices:
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
