A Resolution to Waive the Bid Process and Authorize a Contract for the Purchase of One 78’ x 104’ Steel Sided Building with Wick Buildings

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, a proposal was received from Wick Buildings in the amount of $396,892.00, for the construction of a 78’ x 104’ steel sided building and provides for the potential additional expenditures for services as authorized by the Village Manager and Village Attorney; and,
Whereas, the purchase was budgeted and approved within the FY 2024/2025 budget for a total project budgeted amount not to exceed $750,000 within account 01.08.08.406.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the contract for the construction of the 78’ x 104’ steel sided building. The proposal from Wick Buildings is hereby approved in an amount of $396,892.00, provided, further, however, that notwithstanding the preceding clause, expenditures for services within the scope may be made in amount excess of $396,892.00 but only upon the express approval of the Village Manager and Village Attorney.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
