An Ordinance Approving an Amendment to the Des Plaines River Valley Enterprise Zone Intergovernmental Agreement (Minnick Services Property Expansion Request)

WHEREAS, in 1983, the County of Will, the City of Joliet, the City of Lockport and the Village of Rockdale entered into an Intergovernmental Agreement pursuant to the Illinois Enterprise Zone Act (20 ILCS 655/1 et seq.) for the purpose of establishing an enterprise zone covering certain territory located within each jurisdiction; and
WHEREAS, pursuant to the Intergovernmental Agreement, each party adopted a Designating Zone Ordinance and submitted a Joint Application to the Illinois Department of Commerce and Community Affairs (DCCA) requesting certification of the enterprise zone; and
WHEREAS, in 1983 DCCA approved the Joint Application and certified the formation of the enterprise zone to be known as the Des Plaines River Valley Enterprise Zone; and
WHEREAS, in 1989 the Intergovernmental Agreement was amended to include the Village of Romeoville as a party to the Agreement and to alter the boundaries by including certain territory located within Romeoville; and
WHEREAS, pursuant to the Intergovernmental Agreement. Romeoville adopted a Designating Zone Ordinance which thereafter approved and certified by DCCA in accordance with the law; and
WHEREAS, in 2003 the Intergovernmental Agreement was amended to alter the termination date of the enterprise zone and to limit the financial incentives available to taxable properties located within the enterprise zone, and such amendments which as deemed necessary are done from time to time, and thereafter approved by the State of Illinois; and
WHEREAS, the parties last amended the zone boundaries in the Intergovernmental Agreement and the Designative Ordinance of each party in 2024; and
WHEREAS, the parties have determined that it is appropriate to amend the Intergovernmental Agreement and Designating Zone Ordinance of each party to alter the zone boundaries to include the territory legally described in EXHIBIT 1 and schematically in EXHIBIT 2 (Minnick Services) attached hereto and incorporated herein and to make technical corrections to the legal descriptions of the Enterprise Zone territory; and
WHEREAS, on July 9, 2025, a public notice and public hearing regarding the foregoing proposal will be held as required by Section 5.4 of the Illinois Enterprise Zone Act, where the Board of Directors of the Des Plaines River Valley Enterprise Zone will recommend that this Amendment be adopted by the corporate authorities of the parties.
WHEREAS, the President and Board of Trustees of the Village of Romeoville hereby find and determine that the amendment of the zone is in the best interest of the Village of Romeoville; and
WHEREAS, this Ordinance is adopted in accordance with the Illinois Enterprise Zone Act and pursuant to the powers of the Village of Romeoville.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, ILLINOIS AS FOLLOWS:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: Section 5 of Ordinance No. 1074-88 of the Village of Romeoville, as amended, being the certified designating ordinance adopted by the Village of Romeoville in connection with the establishment of the Des Plaines River Valley Enterprise Zone, is hereby amended to add and read as Exhibits 1 and Exhibit 2 have depicted. The Amendment to the Des Plaines River Valley Enterprise Zone Intergovernmental Agreement is attached as EXHIBIT 3 hereto.
SECTION 3: This Ordinance is strictly intended to approve the addition of the Minnick Services Property to the enterprise zone. In the event the State of Illinois does not approve and certify the addition of the Minnick Services Property, the addition of the enterprise zone shall remain as originally certified by the State of Illinois.
SECTION 4: The Village Clerk and Mayor are hereby authorized to submit a certified copy of this Ordinance to the State of Illinois, the Enterprise Zone Board of the Des Plaines River Valley Enterprise Zone Board and to the administrators, representatives and corporate authorities of the County of Will, the City of Lockport, the Village of Rockdale and the City of Joliet and other interested persons.
SECTION 5: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 6: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 7: REPEALER. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed.
SECTION 8: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law
