A Resolution Authorizing the Waiving of the Bids and Authorizing the Execution of a Contract with Harbour Contractors, Inc. for the Athletic and Event Center Expansion Project

WHEREAS, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of its Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies,
WHEREAS, the Village of Romeoville has received a proposed contract from Harbour Contractors, Inc. for the provision of construction management services in connection with the Athletic and Event Center Expansion Project, a copy of which is attached hereto and incorporated herein as Exhibit A; and
WHEREAS, based upon review of the proposal and the proposed contractor qualifications, the Village has determined to accept the proposal from Harbour Contractors, Inc. attached hereto and incorporated herein as Exhibit A.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby expressly incorporated into and made a part of this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS
5/8-9-1 and the provisions of Chapter 36.43(C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable to attached hereto and incorporated herein as Exhibit A, and authorize the execution of the contract from Harbour Contractors, Inc. for the provision of construction management services in connection with the Athletic and Event Center Expansion Project, a copy of which is attached hereto and incorporated herein as Exhibit A.
Section 3: Repealer: All other Resolutions or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions, or sections thereof.
Section 5: Effective Date: The Resolution shall take effect after its passage, approval, and publication in pamphlet form, as regulated by law.
