A Resolution Authorizing Waiving the Bids and Using the State Bidding Process to Purchase Two 2018 Ford Explorer Utility Vehicles, Ratifying the Purchase of the Same, and Repealing Resolution No. 17-2429

WHEREAS, pursuant to the provisions of 65 ILCS 5/9-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances, the Village of Romeoville may by a vote of 2/3 of the Trustees then holding office, waive the otherwise applicable requirements for public bidding, whether for labor, services or work, the construction of public works or improvements, or the purchase, lease or sale of personal property, materials, equipment or supplies; and

 

WHEREAS, the Village of Romeoville has determined that it is necessary and desirable to use the State of Illinois Purchase Contract #4018223 for the purchase of two Ford Explorer utility vehicles at a price of $25,770 per vehicle, with the total purchase amount being $51,540.00; and

 

WHEREAS, the aforesaid State purchase contract was originally issued to Wright Automotive, Inc. of Hillsboro, Illinois, but due to action of Ford Motor Credit, the responsibility to perform under that contract as it pertains to the Village’s contemplated vehicle purchase has now been assigned or transferred to Morrow Brothers Ford, Inc. in Greenfield, Illinois; and

 

WHEREAS, due to the Village’s immediate need for the above-mentioned vehicles, Morrow Brothers Ford, Inc. has delivered the vehicles in question to the Village and the Village has made payment to Morrow Brothers Ford, Inc. for the same; and

 

WHEREAS, it is in the best interests of the Village to authorize the above-described transaction with Morrow Brothers Ford, Inc and the waiving of the bid process in connection therewith, to ratify the acceptance of and payment for the two Ford Explorer utility vehicles delivered by Morrow Brothers Ford, Inc. in fulfillment of the purchase thereof previously approved from Wright Automotive, Inc., and to repeal Resolution No. 17-2429 authorizing the purchase of such vehicles from Wright Automotive Inc.

 

 

NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, that:

 

Section 1:                     Incorporation of Recitals:  The foregoing recitals are hereby expressly incorporated into and made part of this Resolution as if fully set forth herein.

 

Section 2:                     Waiver of Public Bid Requirement: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of Chapter 36.43 (C) of the Village Code of Ordinances the Corporate Authorities of the Village hereby waive the public bidding requirements otherwise applicable  to the purchase of  two Ford Explorer utility vehicles at a price of $25,770 per vehicle, with the total purchase amount being $51,540.00 under the State of Illinois Purchase Contract #4018223, as now held by Morrow Brothers Ford, Inc.

 

Section 3:                      Ratification of Acceptance of Delivery and Issuance of Payment:  The Village hereby ratifies all actions heretofore taken by all Village personnel in connection with the acceptance of the aforementioned two Ford Explorer utility vehicles, and the issuance of payment for such vehicles. 

 

 

Section 4:                     Repealer:  All other Resolutions or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.  Without otherwise limiting the generality of the foregoing, Resolution No. 17-2429 is hereby repealed.

 

Section 5:                     Severability:  In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, or void, the same shall not affect the validity of enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions or sections thereof.

 

Section 6:                     Effective Date:  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
