AN ORDINANCE AMENDING CHAPTER 81 (MOTOR VEHICLE TOWING) OF THE VILLAGE OF ROMEOVILLE CODE OF ORDINANCES
WHEREAS, the Village of Romeoville has adopted certain ordinances now codified as and for Chapter 81 of the Village Code of Ordinances setting forth and establishing certain regulations regarding the towing of motor vehicles within the Village limits, including the fees permitted to be charged by towing companies participating in the rotation tow program established by said Chapter 81; and
WHEREAS, after Village staff review, it has been determined that it is in the best interest of the Village to amend certain sections of the aforesaid Chapter 81 of the Village Code of Ordinances.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT OF CHAPTER 81.10 OF THE VILLAGE CODE OF ORDINANCES. All those heretofore adopted ordinances of the Village of Romeoville codified as and for Chapter 81.10 of the Village Code of Ordinances are hereby amended to read as hereinafter set forth:
81.10 FEES.
(A) The following schedule of maximum fees shall be in effect for all tows received off the rotation tow list:
Towing Rates (flatbed service mandatory)
Light Duty Vehicle Tow $165.00
Medium Duty Vehicle Tow $180.00
Heavy Duty Vehicle Tow Then-current rates of provider
Medium Duty extended service tow $180/ hour
Heavy duty extended service tow Then-current rates of provider
Up righting $50.00
Winching $50.00 for vehicles within 50 feet of the roadway
$1.00 a foot additional for vehicles beyond 50 feet from the roadway
Lockout Calls $65.00
Gas Delivery $65.00 plus gas
Jump Start (light duty only) $65.00
Tire Change (light duty only) $65.00
Standby:
Light duty tow per half hour after first
half hour on scene $25.00
Medium duty per truck per half hour
after first half hour on scene $25.00
Storage per vehicle - no charge for first
24 hours. After 24 hours $35.00 per day outside
$40.00 per day inside
Light duty after hours release $35.00 additional
Medium Duty $55.00 per day outside
$75.00 per day inside
Heavy Duty Then-current rates of provider

(B) Every tow truck performing towing services pursuant to this chapter shall have a placard describing available rates and services posted in the cab of the vehicle at all times.
Subject to the applicability of Chapter 81.10(C), only fees established by this Chapter 81.10 may be charged. Any additional fee is prohibited.
(C) Where special or unusual circumstances require an exceptional amount of extra work or equipment, a higher fee may be charged; provided, that the owner or operator of the vehicle to be serviced is informed of the additional fee in advance if such person is available to be notified. Charges for rotation tow services shall be on invoice forms, which shall include the above rate structure.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
