Amending Chapter 156 of the Village Code of Ordinances - Residential Rental Property Licensing and Crime Free Housing

WHEREAS, the Village of Romeoville has adopted certain ordinances now codified as

and for Chapter 156 of the Village Code of Ordinances setting forth and establishing certain

regulations regarding the rental property licensing and crime free housing within the Village limits, including definitions, rental property provisions, crime free housing requirements, and inspection requirements established by said Chapter 156; and

 

WHEREAS, after Village staff review, it has been determined that it is in the best interest

of the Village to amend Chapter 156 of the Village Code of Ordinances to revise to add certain definitions in this this chapter.

 

NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF

TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:

 

SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this ordinance as if fully set forth herein.

 

SECTION 2: AMENDMENT OF CHAPTER 156.03 OF THE VILLAGE CODE OF ORDINANCES. All those heretofore adopted ordinances of the Village of Romeoville codified as and for Chapter 156.03 of the Village Code of Ordinances are herby amended to read as hereinafter set forth:

 

156.03 DEFINITIONS,

 

“GUEST.” Means an individual who is present at a tenant’s dwelling unit by invitation, consent, permission, or assent of the lawful tenant, and who is not an owner, occupant, or tenant of that dwelling unit. A Guest remains classified as such only while the individual’s stay does not exceed thirty (30) consecutive calendar days. Any individual who remains in the dwelling unit beyond thirty (30) consecutive days shall no longer be considered a Guest and shall be treated as an Occupant or Tenant for the purposes of this Ordinance.

 

“OVERNIGHT VISITOR.” Means a Guest who remains within a dwelling unit for more than twelve (12) consecutive hours, including during nighttime hours, but whose total presence does not exceed fourteen (14) consecutive calendar days, nor more than twenty (20) days within any sixty (60) day period.

(a)                     All Overnight Visitors must be present with the knowledge and consent of the lawful tenant.

(b)                     An Overnight Visitor who exceeds the time limits set forth above shall be classified as a Guest.

(c)                      A Guest who exceeds the thirty (30) consecutive day limit shall be treated as an Occupant or Tenant under this Ordinance.

 

“UKNOWN OCCUPANT.” Means any individual found residing, lodging, sleeping, storing personal belongings, or regularly entering or exiting a dwelling unit without the consent, knowledge, or authorization of the property owner, property manager, or lawful tenant, and whose presence is not recorded, reported, or reasonably identifiable as a Guest or Overnight Visitor. An Unknown Occupant includes but is not limited to: (a) Individuals staying in a dwelling unit without the permission of the lawful tenant or property owner; (b) Individuals who exceed Guest or Overnight Visitor time limits without disclosure; (c) Individuals whose conduct, presence, or stored belongings indicate habitation or residency regardless of their stated purpose.

An Unknown Occupant shall be presumed an Unauthorized Occupant and shall be subject to the enforcement, compliance, and removal procedures set forth in this Ordinance and related village code provisions.

 

 

SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.

 

SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
