An Ordinance Amending Chapter 112.33(U)-Class U License Classification

WHEREAS, the Village of Romeoville is a home rule unit of government located in Will County, Illinois that has the authority to adopt ordinances pertaining to its government and affairs and to protect the health, safety and welfare of its residents; and
WHEREAS, the licensing and regulation of the sale of alcoholic beverages within the Village of Romeoville is a matter greatly affecting the health, safety, morals, and welfare of the residents of the Village of Romeoville; and
WHEREAS, the Village of Romeoville has the authority to regulate the sale of alcoholic beverages within the Village of Romeoville pursuant to Article 4 of the Liquor Control Act of 1934, 235 ILCS 5/4-1 et. seq.; and
WHEREAS, at the direction of the President and Board of Trustees of the Village of Romeoville, the Village staff has reviewed those ordinances of the Village of Romeoville pertaining to the licensing for the sale of alcoholic beverages within the Village of Romeoville; and
WHEREAS, based upon said review the President and Board of Trustees have determined that it is in the best interests of the health, safety, morals and welfare of the Village of Romeoville and its residents to revise Chapter 112 of the Village Code of Ordinances as hereinafter more fully set forth.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: AMENDMENT TO CHAPTER 112-- All those provisions of all heretofore adopted Village ordinances presently codified as and for Section 112.33(U) of the Village Code of Ordinances shall hereby be amended to read as follows:
(U) Class U License. A Class U license shall authorize the production, storage and retail sale of artisan wine for on-premises consumption in accordance with the terms and conditions hereinafter set forth, the sale of artisan wine for off-premises consumption as hereinafter provided, and the sale of beer and spirits for on-premises consumption. As used herein, “artisan wine” means wine that is manufactured and prepared on the premises of the Class U licensee. The activities authorized herein to a Class U licensee shall be subject to the following terms and conditions:
(1) All artisan wine sold for off-premises consumption shall be sold in containers sealed by the Class U licensee.
(2) A Class U licensee shall demonstrate to the Village that it possesses a manufacturer’s license issued by the State of Illinois for the manufacture of artisan wine.
(3) A Class U licensee shall maintain a menu of food items prepared to order for customers of the Class U licensee by the staff of the Class U licensee.
(4) All alcohol to be served or sold by a Class U licensee to patrons shall be served or sold by an employee of the Class U licensee who has successfully completed a T.I.P.S. alcohol training and certification course conducted by the Police Department or a B.A.S.S.E.T. program approved by the Illinois State Liquor Control Commission within a period of one year immediately prior to the date of the sale or service of the alcohol in question.
(5) A Class U license shall also permit complimentary on-premises consumption of artisan wine for promotional or sampling purposes in conjunction with promotional efforts occurring on the licensed premises, which efforts may be conducted on a daily basis. The sampling shall be attended and supervised by an employee of the Class U licensee and shall be subject to such further regulation as deemed necessary by the local liquor control commissioner. No person shall be served more than 12 ounces of artisan wine for complimentary sampling during a given calendar day.
(6) A Class U licensee may conduct special events on the Class U licensed premises (including that part of the premises located outside of the principal building or structure used for the conduct of the Class U licensee’s business) not more frequently than four times per year, and each such special event shall not exceed two days in duration. Class U licensees may provide live entertainment in connection with the conduct of such special events, Class U licensees shall provide reasonable prior notice of all such special events to the Local Liquor Control Commissioner, and shall conduct the same in compliance with all applicable Village ordinances, and in compliance with the conditions of the Village Special Event Permit. All such special events involving the use of any outdoor portion of the licensed premises for live entertainment shall conclude not later than the hour of 9pm on Sunday through Thursday, and not later than the hour of 10 pm on Friday and Saturday.
(6A) In addition to the conduct of special events as set forth above, Class U licensees shall be permitted to have live entertainment on the outdoor portion of the Class U licensed premises during the months of May through September, provided that all such live entertainment shall conclude not later than the hour of 6 pm. No special event permit shall be required for the provision of live entertainment pursuant to this 112.33(U)(6A).
(7) Class U licensees shall also be permitted to make portions of the Class U licensed premises available from time to time as a bona fide event space. As used herein, a “bona fide event space” means any wholly indoor space within a building operated and continuously made available as a space for customers to rent on a short term basis for the conduct of private, invitation only events, the attendance at which is limited to guests or invitees specifically invited by the customer renting the space in question. The Class U licensee may further permit renters or users of the Class U bona fide event space to arrange for catered food to be served to renters, invitees and guests using a bona fide event space, or to permit such renters, invitees and guests to arrange for catered food or food prepared off-premises to be brought to and consumed on the premises of the bona fide event space by the renters thereof and their guests and invitees.
(8) Notwithstanding any contrary provision of this Chapter, Class U licensees shall only be permitted to sell or serve alcoholic beverages between the hours of 11 am and 11 pm, provided, however, that a Class U licensee using the part of the premises located outside of the principal building or structure used for the conduct of the Class U licensee’s business for special events or the provision of live entertainment shall cease any such use of such part of the premises at 9pm on Sunday through Thursday, and at 10pm on Friday and Saturday.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
