AN ORDINANCE AMENDING CHAPTERS 52 and 54 OF THE VILLAGE OF ROMEOVILLE CODE OF ORDINANCES

WHEREAS, the Village of Romeoville (“Village”) is authorized by law to regulate the use of public and private sewers, wastewater pretreatment, and discharges to the Village’s publicly owned treatment works (POTW) in order to protect public health, safety, and welfare; and
WHEREAS, Chapters 52 and 54 of the Village Code set forth such regulations and the Board of Trustees finds it necessary and appropriate to amend said chapters to reflect current state and federal regulatory requirements and best management practices; and
WHEREAS, the amendments update definitions, clarify sewer connection and maintenance obligations, enhance prohibited discharge standards and local limits, revise pretreatment requirements, and improve monitoring and enforcement provisions; and
WHEREAS, these amendments are necessary to comply with the Illinois Environmental Protection Act, the federal Clean Water Act, and 40 CFR Part 403 (General Pretreatment Regulations).
WHEREAS, the Village Board, after careful and due deliberation, has concluded that the revisions shall be adopted in the form attached hereto and incorporated herein by reference as Exhibit A to this Ordinance.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS; THAT:
SECTION 1: RECITALS. The foregoing recitals are hereby incorporated into this Ordinance as if fully set forth herein.
SECTION 2: ADOPTION OF AMENDED CHAPTERS 52 AND 54 OF THE VILLAGE CODER OF ORDINANCES. Chapter 52 (“Sanitary Sewer Use”) and Chapter 54 (“Wastewater Pretreatment”) of the Village Code are hereby amended in their entirety to read as set forth in Exhibit A attached hereto and incorporated herein by reference. Furthermore, reference to Chapters 52 and 54 shall be added to Appendix A to Chapter 42A of the Village Code of Ordinances to provide for the enforcement of the same by Chapter 42A Administrative Adjudication procedures.
SECTION 3: SEVERABILITY. That the various provisions of this Ordinance are to be considered severable and if any part or portion of this Ordinance shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.
SECTION 4: CONFLICTS. All prior Ordinances and Resolutions, or parts thereof in conflict or inconsistent with this Ordinance are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law, subject to Village Manager and Village Attorney review and approval.
