body
Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, the expenditures for the updated sludge hauling and bio-solids management program contract will be expensed in account number 60.08.23.299; and,
Whereas, Village staff is recommending renewing the updated contract with Stewart Spreading providing up to $300,000 in funding on an annual basis over the next 5 years
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable for the proposal from Stewart Spreading in the amount of up to $300,000 in funding on an annual basis for the updated sludge hauling and bio-solids management program contract. The Village currently has a 5-year contract with Stewart Spreading for a complete Bio-Solids Management Program that was approved by the board on 2/17/21 under resolution # 21-3085. Public Act 103-327 which took effect on 1/1/24 now requires that sludge hauling from our wastewater treatment facility be paid at prevailing wage rates. Due to this new requirement, Stewart Spreading has provided the Village with an updated 5-year contract beginning in 2024 at a rate of $28.14 per cubic yard up from $22.16 at the end of calendar year 2023. The years 2025-2028 would see an annual CPI adjustment like the current contract in place.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
