Title

An Ordinance Approving a Special Use Permit for a Planned Unit Development - Final Development Plan for All World Storage (315 N Independence Blvd)

 

Body

WHEREAS, Gidget Callaghan, manager of 315 Independence, LLC, holder of the beneficial interest under a trust agreement known as First Midwest Bank Trust No. 802 (hereinafter referred to as “Developer”) has requested the approval of a Special Use Permit for a Planned Unit Development - Final Development Plan for All World Storage at 315 N Independence Blvd; and,

 

WHEREAS, said request is for the 20 acre site with the PIN of 11-04-03-102-008-0000; and,

 

WHEREAS, said site has been covered by multiple previous approvals including: ORD 98-2552 An Ordinance Authorizing a Special Use Permit for a Planned Unit Development; ORD 99-2549 An Ordinance Directing the Execution of an Annexation Agreement; ORD 02-0083 An Ordinance Approving and Amendment to the Annexation Agreement; ORD 02-0078 An Ordinance Approving a Special Use Permit for a Planned Unit Development; and RES 14-1883 A Resolution Authorizing the Execution of a Redevelopment Agreement; and,

 

WHEREAS, said request for a Final Development Plan would replace the previous approvals with a current and accurate site plan; and,

 

WHEREAS, said request for a Final Development Plan includes the following exhibits:

                     Site Plan drawn by Geotech Inc. with the most recent revision dated 11-7-16 and attached as Exhibit A; and,

                     Vehicle Parking Restrictions attached as Exhibit B; and,

 

WHEREAS, said request has met all of the procedural requirements of the Village of Romeoville, Village Board of Trustees, Planning & Zoning Commission, Development Review Committee, and the Code of Ordinances, as amended; and,

 

WHEREAS, the Planning & Zoning Commission held a Public Hearing on December 13, 2016 to discuss the proposal as outlined in the PZC Report attached as Exhibit C; and,

 

WHEREAS, said request meets with the approval of the Village of Romeoville and hereby authorizes Developer to proceed according to the Development Regulations, Zoning Code and various requests made by the Development Review Committee, Planning & Zoning Commission, and Village Board of Trustees.

 

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

 

Section 1:                     That the above recitals and referenced reports are hereby incorporated and made a part of this Ordinance;

 

Section 2:                     That approval of the Special Use Permit for a Planned Unit Development - Final Development Plan is hereby granted by the Village, in which the Village President is hereby authorized to sign, and the Village Clerk attest thereto, that the said Final Development Plan has met all of the requirements as herewith attached and is authorized to proceed at the site legally described as follows:

 

THAT PART OF THE NW1/4 OF SEC. 3, T36N-R10E, DAF: COMM AT A POINT WHERE THE CENTERLINE OF HWY ALTERNATE US 66 INTERSECTS WITH THE S LINE OF THE N1/2 OF THE SAID NW1/4; THENCE E ALONG THE S LINE OF SAID N1/2 OF THE SAID NW1/4, 1089 FT; THENCE N 800 FT; THENCE W TO THE CENTERLINE OF SAID HWY ALTERNATE U.S. 66; THENCE S ALONG THE CENTERLINE OF SAID HWY, 800 FT TO THE POB.

Section 3:                     That the location of the storage containers and parking lot as shown in Exhibit A shall be deemed in compliance with Village code regarding setbacks, and that all vehicles parked on the property shall comply with and be subject to the restrictions set forth in Exhibit B to this Ordinance.

 

Section 4:                     That this ordinance is replaces the previous approval contained in ORD 98-2552 An Ordinance Authorizing a Special Use Permit for a Planned Unit Development; ORD 99-2549 An Ordinance Directing the Execution of an Annexation Agreement; ORD 02-0083 An Ordinance Approving and Amendment to the Annexation Agreement; ORD 02-0078 An Ordinance Approving a Special Use Permit for a Planned Unit Development.

 

Section 5:                     That this ordinance is in compliance with the Redevelopment Agreement adopted as RES 14-1883.

 

Section 6:                     That the total number of storage unit spaces on site shall not exceed 2,344.  A “storage unit space" shall, for purposes of this Ordinance, be defined as a metal container or trailer not in excess of twenty feet in length and eight feet in width that is substantially identical to those existing on the property legally described in Section 2 of this Ordinance as of the date of this Ordinance, or a space not in excess of twenty feet in length and eight feet in width.  All metal storage containers or trailers presently or hereinafter existing on the Subject Property shall be placed on the surface of the ground, and shall not be placed or stacked upon or on top of other storage containers or trailers. Oversized storage containers in excess of the size of a storage unit space may be placed within the property described in Section 2 of this Ordinance, but shall count as two storage unit spaces for purposes of this Ordinance.  To facilitate vehicle parking on the property described in Section 2 of this Ordinance, storage unit spaces may be converted into vehicle parking spaces, at a ratio of two vehicle parking spaces for every three storage unit spaces.  For purposes of this Ordinance, a “vehicle parking space” shall consist of a space not in excess of twenty feet in length and twelve feet in width.  Subject to Exhibit B, oversized vehicle may occupy multiple vehicle parking spaces.  Notwithstanding any other provision of this Ordinance, no storage containers presently existing within the perimeter wall or boundary of storage containers on the property described in Section 2 of this Ordinance shall be converted into vehicle parking spaces, nor shall any containers presently existing within the perimeter wall or boundary of storage containers on the property described in Section 2 of this Ordinance be removed or relocated without the approval of the Village Department of Community Development.  Upon request of the Village Department of Community Development made not more frequently than annually, the developer, owner or operator of any storage facility located on the property described in Section 2 of this Ordinance shall from time to time advise the Village as to the then-existing numbers of storage unit spaces and vehicle parking spaces then being maintained within the property.

 

Section 7:                      That this Ordinance shall become effective upon its passage, approval and publication as provided by law.
