A Resolution Objecting Opposing and Protesting Approval of a Zoning Amendment for a Parcel of Property Contiguous with the Village of Romeoville Located in the North Half of the West Half of the North Half of the Southwest Quarter of Section 36, in Township 37 North, Range 10 East of the Third Principal Meridian, in Will County, Illinois Pin Number: 12-02-36-300-001-0000 Under Case Number Zc-25-052 (13141 High Road)

                     WHEREAS, Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois provides that any municipality which has a population of more than 25,000 is a home rule unit, and the Village of Romeoville, Will County, Illinois has a population in excess of 25,000 and therefore is, therefore a home rule unit and, pursuant to the provisions of said Section 6(a) of Article VII, may exercise any power and perform any function pertaining to its government and affairs, including, but not limited to, the power to tax and incur debt; and

                     WHEREAS, Section 5-12014 of the Illinois Counties Code and Sections 155-163.30, and 155-16.40 of the Will County, Illinois Code of Ordinances, provide for a municipality to object oppose and protest the approval of an application to amend the map, special use permits and/or variances of a property that lies within one and one and a half miles of the corporate boundaries it deems not to be in the best interest of the municipality and its residents; and

                     WHEREAS, the parcel of property has a common address of 13141 High Road, and is located at THE NORTH HALF OF THE WEST HALF OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF SECTION 36, IN TOWNSHIP 37 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS: PIN Number: 12-02-36-300-001-0000 is contiguous with the Village of Romeoville’s municipal limits, located within the planning area of the Village of Romeoville, and within one and one-half miles of the corporate boundaries of the Village of Romeoville in unincorporated Will County; and

                     WHEREAS, notwithstanding any statements to the contrary in the application for the zoning amendment or in the notice of public hearing on the amendment, in the event of the approval of the requested zoning amendment to I-3, the regulations of the I-3 District would permit the storage of semi-trucks, tractor-trailers, trailers and over the road trucks on the premises, threatening substantial damage to High Road from the movement of the same to and from the property subject to the proposed zoning amendment; and                     

                     WHEREAS, I-3 zoning allows the most intensive industrial uses and High Road is not designed to accommodate heavy industrial truck traffic, given its 5 Ton weight limit; and

                     WHEREAS, while the proposed zoning amendment to I-3 would permit the development and use of the site as a truck or trailer storage facility, no buildings or improvements, including but not limited to the provision of sanitary facilities, are contemplated as part of the proposed development, raising concerns about the day to day management of the site as developed, and its maintenance and upkeep in a manner that keeps the property free from code violations and unsanitary conditions; and

                     WHEREAS, the property subject to the present zoning amendment application has recently been the subject of a prior special use permit application in Will County Land Use Case No. ZC-24-034 intended to permit a substantially similar use to that reflected in the present zoning amendment application, which special use permit application was previously denied by the Will County Board on August 15, 2024, and the present zoning amendment application to classify the property as I-3 would permit any number of more intensive uses of the property subject to the zoning amendment application, which application should likewise be denied given that it permits the conduct of uses more intensive than those reflected in the previously denied special use permit application; and

                     WHEREAS, the application and public notice provided to the Village indicate that the proposed use will involve the placement of asphalt grindings, the use of which is opposed by the Village due to the likelihood that such grindings will be deposited onto High Road, requiring further cleaning and maintenance activities and expenditures by the Village; and

                     WHEREAS, the application discloses a lack of adequate screening in the form of a full landscape buffer and privacy fence to shield adjacent or nearby residential dwellings from the proposed use; and

                     WHEREAS, the property subject to the proposed zoning amendment is within the Village’s one and a half mile planning jurisdiction, and is indeed contiguous to the corporate limits of the Village, but the proposed amendment to I-3 is inconsistent with the provisions of the Village’s East Side Plan within the 2017 Comprehensive Plan, which contemplates mixed use developments involving the construction of buildings served by utilities with a variety of uses along with open space

                     WHEREAS, the Mayor and Board of Trustees find that it is in the best interest of the Village and its residents to object oppose and protest the approval by Will County of the Will County Zoning case #ZC-25-052 for the parcel of property located in THE NORTH HALF OF THE WEST HALF OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF SECTION 36, IN TOWNSHIP 37 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS PIN NUMBER: 12-02-36-300-001-0000;

                     NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, IN THE EXERCISE OF ITS HOME RULE POWERS, AS FOLLOWS:

SECTION ONE.  The foregoing Recitals are hereby incorporated into this resolution as if fully set forth in this Section 1.

 

                     SECTION TWO.   That the Village President is authorized and directed to execute this Resolution, and the Village Clerk is authorized and directed to attest thereto.

 

SECTION THREE.  That the various provisions of this Resolution are to be considered severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

                     SECTION FOUR.  All prior Resolutions, or parts thereof in conflict or inconsistent with this Resolution are hereby expressly repealed only to the extent of such conflict or inconsistency.

 

                     SECTION FIVE.  This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
