A Resolution Waiving the Bidding Requirements and Accepting the Proposal from Cargill for the Purchase of an AccuBatch Brine Maker Utilizing Sourcewell Contract Pricing

Whereas, The Village of Romeoville ("The Village") is a municipality in accordance with the Constitution of the State of Illinois of 1970; and,
Whereas, The Village of Romeoville will utilize the brine maker for the production of brine for winter operations; and,
Whereas, The Village has received a quote from Cargill for the purchase of the equipment utilizing the Sourcewell Contract Pricing; and,
Whereas, The Village has $100,000 budgeted in the approved FY 25/26 Budget for the purchase of the proposed equipment along with upfitting the existing facility the equipment will be placed within. The purchase price of the brine maker is $48,196.00 utilizing the Sourcewell Contract pricing; and,
Whereas, The Village Staff recommends waiving the bidding requirements for the purchase of the brine maker utilizing funds in the account 01.08.15.409; and,
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Reguirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793- 00 the Village hereby waives the public bidding requirements otherwise applicable to the purchase of the AccuBatch brine maker in the amount of $48,196.00 from Cargill utilizing the Sourcewell Contract Pricing.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words. phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
