A Resolution to Waive the Bid Process and Accept the Proposal from Denler, Inc, the Sole Provider for HA5 Surface Treatment Placement

Whereas, pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00, the Village of Romeoville may vote by 2/3 of its Trustees then holding office to waive the requirements for public bidding on Village public work, or improvement projects; and,
Whereas, the expenditures for pavement surface treatment are allocated in the Fiscal Year 2026/2027 Budget; and,
Whereas, a proposal of $260,478.21 has been received from Denler, Inc. for the placement of high-density mineral bond surface treatment at various multi-use paths throughout the village; and,
Whereas, paths included in this proposal, along with the parking lots to be sealcoated under a separate proposal and resolution, will be treated for a total cost not to exceed the budgeted amount of $415,000. Additional path locations may be added at the same unit prices provided in this proposal.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: Incorporation of Recitals: The foregoing recitals are hereby incorporated into this Resolution as if fully set forth herein.
Section 2: Waiver of Public Bid Requirements: Pursuant to the provisions of 65 ILCS 5/8-9-1 and the provisions of the Village Ordinance No. 2793-00 the Village hereby waives the public bidding requirements otherwise applicable to the placement of pavement surface treatments and accepts the proposal from Denler Inc in the amount of $260,478.21 for HA5 placement on multi use paths within the Village.
Section 3: Repealer: All other Ordinances or parts of ordinances of the Village of Romeoville that are inconsistent with this ordinance are hereby expressly repealed.
Section 4: Severability: In the event any word, phrase, clause, sentence, paragraph, provision, or section of this Resolution or any portion thereof shall be held to be unconstitutional, unenforceable, or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, or sections thereof.
Section 5: Effective Date: The resolution shall take effect after its passage, approval, and publication in pamphlet form, as provided by law.
