A Resolution Approving an Easement Agreement Between the Grand Prairie Water Commission and the Village of Romeoville (1070 W. Airport Road Secondary Delivery Structure Site)

WHEREAS, the Village of Romeoville (the “Village”) is a member of the Grand Prairie Water Commission (the “Commission”), together with the City of Joliet, the Village of Channahon, the City of Crest Hill, the Village of Minooka, and the Village of Shorewood; and
WHEREAS, pursuant to Article VII, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act, 5 ILCS 220, the Village and the Commission have the power to contract or otherwise associate among themselves “to obtain or share services and to exercise, combine or transfer any power or function, in any manner not prohibited by law or by ordinance” as well as to use their revenues, credit and other resources for such activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., also authorizes the joint use and enjoyment of the powers, privileges, functions and authority of the Village and the Commission; and
WHEREAS, the Commission and Village have determined that it is necessary and desirable to enter into an easement agreement (the “Agreement”), a copy of which is attached hereto and incorporated herein as Exhibit A; and
WHEREAS, the Agreement provides an easement to the GPWC for the installation, operation maintenance and abandonment in place of a water delivery structure and associated water main in connection with the provision and delivery of Lake Michigan water to the Village as a member of the GPWC together with rights of ingress and egress to the location of such facilities; and
WHEREAS, the Village Board of the Village has determined that it is in the best interest of the Village and its residents to approve this resolution and thereby approve the Agreement; and
NOW, THEREFORE, BE IT RESOLVED BY THE President and Board of Trustees of the Village of Romeoville, COUNTY OF WILL, STATE OF ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated in and made a part of this resolution as findings of the Village Board of the Village by this reference.
SECTION TWO: APPROVAL OF THE AGREEMENT. The Agreement is hereby approved in form and substance conforming to the Agreement attached to this resolution.
SECTION THREE: EXECUTION OF THE AGREEMENT. The Village President and the Village Clerk are hereby authorized and directed to sign and seal the Agreement in form and substance conforming to the Agreement attached to this resolution.
SECTION FOUR: DELIVERY OF RESOLUTION. The Village Clerk is hereby authorized and directed to return a signed copy of the Agreement and a certified copy of this resolution to the Commission within fourteen (14) days after the date of adoption of this resolution.
SECTION FIVE: EFFECTIVE DATE. This resolution shall be in full force and effect upon its passage and approval in the manner required by law.
